Conditions of use
REGISTRATION FOR SUPERVISED GROUP TRAINING SESSIONS
Registration for supervised group training sessions is done strictly via the NAUTILUS PLUS web site and processed at the NAUTILUS PLUS branch chosen by the CONSUMER to participate in the sessions. Registration is accepted as long as the session are available at the time of reservation on the NAUTILUS PLUS web site.
The cost of the session is as stipulated on the NAUTILUS PLUS web site. Registration must be secured with a deposit of ninety dollars ($90.00 +tx). Payment is accepted by credit card only. Once payment conditions are met and authorized, the CONSUMER will receive an email confirmation with a receipt featuring a bar code.
To complete registration, the CONSUMER must go to the chosen branch, with the receipt bearing the bar code, at least forty-eight (48) hours before the start of the first group training session, in order to pay the balance due. Payment of this balance will be made in two (2) installments. The first, representing 50% of the total cost less the $90.00 +tx deposit plus taxes, is due the first day of the session, and the second, representing 50% of the total cost, is due the fifth week of the session.
The CONSUMER will sign a contract upon registration at the branch, at which time he or she will receive a personal copy of the contract with a passport authorizing use of the branch at the time of the supervised group training sessions.
RESPONSIBILITIES
NAUTILUS PLUS reserves the right to cancel a session should the minimum number of five (5) persons not be reached. NAUTILUS PLUS agrees to inform the CONSUMER of any and all cancellations by email or by phone, in which case NAUTILUS PLUS will refund the CONSUMER in full. The CONSUMER is, however, entitled to choose another session.
NAUTILUS PLUS reserves the right to cancel a reservation for a session should CONSUMER identification or his or her email address be erroneous.
The CONSUMER acknowledges that all sports activities or physical training which he or she may carry out, participation in any of the activities offered by NAUTILUS PLUS, use of all equipment, services, or training areas of NAUTILUS PLUS, all involve inherent risk and are therefore entirely at his or her own risk. Consequently, the CONSUMER hereby releases NAUTILUS PLUS and grants a full, final, complete, and definitive discharge to NAUTILUS PLUS and to its representatives, employees, shareholders, directors, officers, managers, agents, representatives, officials, insurers, heirs, executors, successors and assignees, or to any other person for whom NAUTILUS PLUS is responsible, from all liability, request, cause of action, claim, recourse, action, conflict, dispute and/or pursuit of any kind or nature whatsoever, in law or in equity, present or future, resulting directly or indirectly from the use of any of the services or equipment provided for in the present contract or otherwise from the participation in any of the sports activities or physical training provided by NAUTILUS PLUS, renouncing to such a request, cause of action, claim, recourse, action, conflict, dispute and/or pursuit, save in the event of the personal act of NAUTILUS PLUS or its representatives and for which the onus falls upon the CONSUMER.
POLICY FOR CANCELLATION BY THE CONSUMER
Sessions are refundable in full before their starting date. For cancellations to be processed, the CONSUMER must contact the branch where he or she registered.
After the beginning of the session, the CONSUMER can cancel the present contract within a period equal to one tenth (1/10) of the duration of the session defined therein by sending to NAUTILUS PLUS the form annexed to the contract or other written notice to this effect. In that case, the MERCHANT may not claim from the CONSUMER payment of any sum greater than 1/10 the total cost prescribed in the contract.
NAUTILUS PLUS must return to the CONSUMER the money owed within the ten-(10-) day period following cancellation of the contract.
CLAUSE REQUIRED UNDER THE PROTECTION OF THE PERSONAL INFORMATION ACT
The personal information that the CONSUMER supplies and that NAUTILUS PLUS gathers with regards to services is kept in a file known as the 'CONSUMER File'. Authorized employees at the chosen branch and in the finance department at the NAUTILUS PLUS head office have the right of access to the CONSUMER file. Authorized representatives or agents of NAUTILUS PLUS also have access to the CONSUMER file regarding the performance of a contract concluded between the parties. All files are kept at the branches and/or the NAUTILUS PLUS head office. Unless restricted by Law, the CONSUMER has the right to access and modify the personal information in your file by sending a written request to the above-mentioned address. ln order to help us keep a personal information file that is up-to-date and accurate, the CONSUMER must inform NAUTILUS PLUS of any change without delay. Notwithstanding the foregoing, in cases where the CONSUMER makes payment of his/her registration by credit card and the credit card is lost, stolen, or expires during the term of the present contract or any renewal thereof, NAUTILUS PLUS is hereby expressly authorized by the CONSUMER to contact the financial institution that issued the credit card in order to update the information necessary to enable the fulfillment of the financial obligations under the contract.
Under the Protection of Personal Information Act, the CONSUMER must consent to provide NAUTILUS PLUS with his or her e-mail address, as a means of communication between the parties. This consent form authorizes NAUTILUS PLUS to use the CONSUMER’S e-mail to forward any information regarding registration, renewal, and promotional offers or any other pertinent information.
